FOR IMMEDIATE RELEASE<\/strong><\/span><\/p>\n BARRY MOORE APPLAUDS APPELLATE COURT DECISION IN FLYNN CASE,<\/strong><\/span> Enterprise, AL–AL-2 Congressional candidate Barry Moore applauded Wednesday’s Appellate Court decision ordering the dismissal of charges against retired General Michael Flynn. The U.S. Court of Appeals for the District of Columbia Circuit ruling ends Flynn\u2019s years-long legal saga which started with a prosecution brought by special counsel Robert Mueller.<\/span><\/p>\n Flynn pled guilty in late 2017 to lying to the FBI, but in December 2019 moved to withdraw his plea, citing inadequate legal counsel, among other reasons. Following an internal review of the investigation, the Department of Justice moved in May to drop the charges against Flynn. However, the presiding judge in the case, Clinton-appointed Judge Emmet Sullivan, instead appointed an amicus curiae (friend of the court) to argue against the prosecution and to argue in favor of charging Flynn with contempt for reversing his plea. Flynn\u2019s legal team filed an emergency petition for a writ of mandamus with the appeals court to order Sullivan to approve the motion to dismiss the case, and the appeals court heard oral arguments from all parties last week.<\/span><\/p>\n On Wednesday, the Court of Appeals decision ruled that \u201cThe district court is directed to grant the government\u2019s motion to dismiss.\u201d<\/span><\/p>\n Moore said in a statement:<\/span><\/p>\n \u201cI applaud the ruling by the Court of Appeals in General Flynn\u2019s case. Finally, this great patriot has received justice. He was caught up in the political-motivated witch hunt of the Muller investigation, but now his legal nightmare is finally over.<\/span><\/p>\n \u201cI understand all too well the General\u2019s situation. In 2014 my family and I went through the same kind of witch hunt and perjury trap as General Flynn. In our case, I was found Not Guilty on all counts and totally vindicated by a Lee County jury. Both of us were the victims of overzealous prosecutors with political agendas. But, we were patient, let the facts come to light, and so justice finally prevailed.<\/span><\/p>\n \u201cThe American justice system isn\u2019t perfect but it\u2019s the best in the world, where an accused is presumed innocent and allowed due process.<\/span><\/p>\n \u201cOur prayers are with General Flynn and his family today, and I believe that they will come out of this stronger than ever, just as my family did.\u201d<\/span><\/p>\n Barry Moore is on the Republican ballot in the July 14th runoff election.
